Why and how does our relationship work?

Our relationship with you and this incentive is based on our expertise as real estate Consultants and your ability to search and find properties that are currently on the market (your part is easy). As you know, in today’s real estate market, everything that is listed on the multiple listing service is available to be seen on hundreds of duplicated websites. Independent surveys state that 98% of buyers search the internet to find a home. Virtually no one surveyed said that their agent found them a home that they had not seen on the internet or by driving around. If you are one of the 98% of the buyers out there doing their own work, we figure why not pay you for your efforts so that we can serve more people and focus on the contract and process as our expertise. We know that this process will not work for everyone and we will help you find the home as a high priority client if needed – we still know how to do that too.

Is this legal?

The real estate law in Georgia says that we can give a broker incentive to any buyer as long as the buyer is listed on the settlement statement as a principal. On a side note, the law also states that we can not give a referral fee to a person that is not a real estate agent when they send a friend to us to use the incentive. But, with that said, please don’t forget that your referrals are greatly appreciated! We need more raging advocates and we will earn your respect, your future business and your friends.

What you need to do next (like right now – before you see anymore properties)!

Immediately meet with a Duffy Buyer Consultant to become a Duffy client by signing a Buyer’s Brokerage Agreement. Becoming a Duffy Realty client helps ensure that we are eligible to receive a commission that is paid by the seller of the home. We will do our best to allow you to see houses outside of the incentive, but we must schedule the showing for you with the seller and/or listing agent. Otherwise the listing agent may claim that they are entitled to the full commission.

Homes that you are serious about purchasing and have seen prior to becoming a client will need to be discussed with the listing agent by us to determine their rights to procure the whole commission. IT IS VERY IMPORTANT THAT WE BECOME ENGAGED IN AN AGENCY RELATIONSHIP IMMEDIATELY to protect our right to a commission, thus giving you the incentive. Also, if we do not represent you, please do not state that we do to other people OR that you are going to use us to buy a home if we have not interviewed you to see if we can help you.

At the meeting we will:
1. Show you your rights and the seller’s rights inside the 2005 printing of the Georgia Realtor Association contract used to purchase a resale home. This is a very informative presentation that will arm you with good knowledge and lingo to keep everyone on the same page.
2. Discuss the 2005 Buyer Brokerage Agreement and give you an early termination form that you can use to exit the agreement.
3. Review your needs and wants in a home. We will also determine if we are able to help you with your purchase.
4. Get you started with our free auto-notification system that will notify you of all and then any new homes on the market as they are added using our elaborate tools which are must better than the tools that you have access to now. This notification system is speedy and very up-to-date. You receive that day’s new listings by email.
5. Add you to our for sale by owner matching system so that for sale by owner sellers can notify us when they believe that their home matches your wants – a Duffy Realty exclusive marketing system.
6. Explain how to contact us when you want to see a home (new or resale).
7. Give you our business cards for you to use when previewing homes without us.
8. Get a timeline set for when you want to accomplish buying a home (now or 1 year from now does not matter).
9. Give you homework items that will help you make the right decision when you are purchasing your home and give you guidelines about which ones you should choose to see using the incentive.
10. Learn how we track the homes that you have seen with us so that all expectations are met from all parties.

Rules of Incentive Program:

1. Meet with Duffy consultant to determine your eligibility before you state in public that we represent you.
2. Sign a Buyer Incentive Program and Buyer Brokerage Agreement, before you make an offer on any home.
3. If you are buying a Duffy home, you must state your desire to use the incentive before negotiations begin with the seller and sign the proper paperwork as stated above.
4. Do your share of the work to find the home within the guidelines of the Incentive Program.
5. Duffy Realty honors the most current revision of the Buyer Incentive Program only unless you have previously signed a Buyer Cash Bonus or Buyer Incentive Program.

The meeting will take about 30 minutes or less. We hold group meetings as well as individual meetings both at a location convenient to you or at our office at 10 Cumming Street, Alpharetta, GA 30004.

What is each of our duties?

While under an Exclusive Buyer Agreement with Duffy Realty, our duties will include:
Confidentiality
Expert guidance and advice about the resale potential of the homes we see with you
Thorough contract negotiation
Inspection negotiation
Closing set-up, advice and review of settlement statement

While under an Exclusive Buyer Agreement with Duffy Realty, your duties will include:
Advising others that you are represented by Duffy Realty as a client
Searching and doing an exterior preview of homes that interest you
Reasonable intent to purchase a property with good will

Your incentive pay-out is based on the amount of properties we see with you:

1 to 3 properties 50%
4 properties 45%
5 properties 40%
6 properties 35%
7 properties 30%
8 properties 25%
9 properties 20%
10 properties or more $ 500.00

A fee of .0034 of the sales price is deducted from the incentive given to the buyer. There is no time limit. You may take as long as you need to find your home. We will not write a contract without seeing the home first. Your incentive will be ready for you to pick-up or mail 5 business days after closing.
