Who Holds The Earnest Money

If your buyer is working with an agent, the agent's company will hold the earnest money.

If the buyer is not working with an agent, we will give you, the seller, an exhiibit to the contract and you will hold the earnest money. 

If you and your buyer can not work it out so that you will hold the earnest money, our prefered closing attorney, Dreger and Coyle, will hold the earnest money for you if you close at one of their offices.  They do require an addendum that we can give you.  This should be the option only after your buyer says "no" to you holding the earnest money, which is very rare.
